Comparative contract law

It is suggested to have passed the exams Comparative Legal Systems or Sistemi Giuridici Comparati and of Diritto Privato 1 and 2.
In accordance with the formative aims of the Law Degree (LMG/01), the course aims at giving the essential methodological tools in order to compare the different models of contract law in the comparison civil law-common law. The expected formative aim is to obtain the knowledge of the basic notions of contract in order to be able to understand and face the differences of the main issues of contract law.
The course will cover the following topics:
1) the problem of definition of contract: contract as agreement and contract as promise;
2) the formation of contracts
3) precontractual liability;
4) breach of contract
5) penalty clauses.

The textbook suggested (H. Kötz European Contract Law, second edition, Oxford University Press, 2017) is available in the Law Library.
Students attending the course will be suggested specific parts of the book to read and other materials to facilitate the preparation of the exam.
- The method of teaching will consist of lectures and dialogues, also through discussions of cases.
- The exam will consist in the answer to questions proposed by the teacher on the issues covered. The assessment will aim at verifying the comprehension of the various topics and an adequate use of the correct terminology.
