  • 28 febbraio 2024 MID-TERM WRITTEN TEST - FUNDAMENTAL RIGHTS 23-24

    Dear students,

    As mentioned during the last lecture, I would like to inform you that the mid-term written test on the first part of the course will take place on Tuesday, March 19, 2024, at 2:00 PM in Classroom 2 (floor -3). The test will last for one hour and will consist of 5 open-ended questions. I kindly ask you to be punctual at 2:00 PM. I will provide the answer sheets. Thank you.

     

  • 15 novembre 2023 EXAMS FUNDAMENTAL RIGHTS DEC 2023 – JAN 2024

    The exams of Fundamental Rights of December 2023 and January 2024 will be supervised by Prof. Chiara Bergonzini, since Prof. Menegus is going to be abroad for a research stay.

    To sign up for the exams in December 2023/January 2024, it is necessary to select the exam dates of Prof. Bergonzini instead of those of Prof. Menegus.

    Gli appelli di dicembre 2023 e gennaio 2024 saranno tuttavia presieduti dalla Prof.ssa Chiara Bergonzini, in quanto il Dott. Menegus sarà all’estero per un soggiorno di ricerca.

    I compiti saranno comunque predisposti e corretti dal Dott. Menegus.

    Per iscriversi all’esame negli appelli di dicembre 2023 e gennaio 2024 è necessario selezionare gli appelli della Prof.ssa Bergonzini (che sarà formalmente Presidente della Commissione d’esame).

  • 23 gennaio 2023 CONSTITUTIONAL LAW – 6 CFU

    For students who have to take the Constitutional Law – 6 CFU exam, the program is the following and corresponds to the second part of the course of Fundamental Rights – 9 CFU.Nonetheless, participation in the first part of the late is strongly recommended as a helpful opportunity to refresh knowledge of Diritto costituzionale 1.

     

    Obiettivi formativi

    In the second part of the course (6 CFU), particular attention will be paid to the Italian Constitutional Court’s role and the degree of protection granted to fundamental rights by courts at different levels (multilevel protection of fundamental rights). The use of court cases in the lectures will make students deal with first-hand materials, facilitating them to acquire familiarity with vocabulary and valuable practice for their academic and professional careers.

     

    Prerequisiti

    Basic knowledge of Italian constitutional law is necessary, as acquired in Diritto costituzionale 1.

     

    Contenuti

    The second part of the course (6 CFU) aims to set the Italian constitutional system in the European legal area. A list of crucial court cases from the Italian Constitutional Court, the European Court of Human Rights, and the Court of Justice of the European Union is analysed to reconstruct the system of fundamental rights protection in the European context. Most of this second part of the course will be focused on cases and precedents to stimulate discussion during the classes.

    The main topics are the following:

    -          The Italian Constitution in the European Legal Area

    -          Italian Constitutional Court and Constitutional Adjudication

    -          Multilevel Protection of Fundamental Rights

    -          Selected case-law

     

    Metodi didattici

    Except for the introduction to constitutional adjudication and the theory of fundamental rights, the second part of the course (6 CFU) has a solid practical approach. Students will be involved actively in class discussions of the cases: small groups of discussion leaders will be selected for each class to present specific cases to their colleagues under the supervision of the Professor.

    Renowned scholars may be invited as guest speakers.

     

    Modalità di valutazione

    Oral examination. The student will be required to show their knowledge of constitutional law and the ability to apply it to practical cases. The student is expected to analyse sources and theories independently and use the appropriate legal vocabulary, thus proving that they have acquired the study method.

    The evaluation criteria are the following:

    - knowledge and understanding of constitutional law/fundamental rights law and ability to apply them to concrete cases (65%);

    - appropriate use of legal vocabulary, ability to analyse and evaluate sources, and acquisition of the study method (35%).
